Particulars of Organization, Functions & Duties

 

INTRODUCTION:

The Motor Vehicles department in the State was in existence before the statehood under the erstwhile Assam State in the two districts of Kohima and Mokokchung with assignment of the Registration Mark of ASH for the Naga Hills districts. The registrations were very negligible therefore there was no separate licensing authority but Superintendent of Police was designated as the licensing authority.

On attaining statehood, the two Regional Transport Officer’s offices were opened at Kohima and Mokokchung. Thereafter, the expansion and growth of the offices in the rest of the district was very slow. The District Transport Officer’s office at Mon, Tuensang, Wokha, Zunheboto, Dimapur and Phek were opened during a span of 40 years after the first office was opened at Kohima.

 

ACHIEVEMENTS

  • Physical

 

The Department has completed constructions of Office building cum pollution testing centres at Mon, Tuensang, Phek and Dimapur. The Department has completed construction of Inter State Truck Terminus (ISTT) at Dimapur which was inaugurated on 7th August, 2015. The constructions of the Office building cum pollution testing centre at Mokokchung and the Office building of the Transport Commissioner at Kohima, are in progress.

  • Revenue

The Department collected total revenue of Rs. 10530.01 lakhs from 1st April 2017 to 31st March 2018 against the annual revenue set target of Rs.6500.00 lakhs

The department is also among the first in the country to issue Smart Card Driving Licenses and Registration Certificates. Migration from the first generation software, Naga Soft, to national software,  VAHAN for registration of vehicles and adoption of SARATHI for issue of driving licences are successfully completed at par with the rest of the country and all the 8(eight) Registering and Licensing offices of the state are now fully digitised.

  • The Department has launched High Security Registration Plate in the state

w.e.f.15.06.2011.

VISION:

The vision of the department is to go full e-governance and paperless.  Adoption of the national soft ware, Vahan and Sarathi, is enhancing the ability of the Department to improve its service delivery system. The Department is working in collaboration with the Department of Information Technology through SWAN for on-line application for services required.

By 2020, the Department in collaboration with the Departments of Police, PWD (R&B), Health & Family Welfare and Education aspires to achieve set targets of making our roads safe for
all types of road users and reduce road accidents. Aiming at providing effective, efficient and transparent citizen-centric service delivery, the Department is adopting the latest IT tools to achieve them.

The Department is set to pursue:

  • Capacity building and constant up-gradation of the skills of members of the staff of the Department;
  • Establishment of Institute of Drivers’ Training & Research;
  • Enhancement of skills of Drivers through training:
  • Upgradation of services delivery through IT application:
  • Totally digitised documentation through IT application.

The Motor Vehicles Department at the Secretariat is headed by the Commissioner & Secretary to the Government of Nagaland, Transport Department. The Motor Vehicles Department in Commissionerate is headed by the Transport Commissioner with the office located at old MLA Hostel Building, Kohima. The Department is broadly divided into two Zones namely, the Kohima Zone and the Mokokchung Zone. The two Zones are placed under a Regional Transport Officer each. The rest of the district offices at Mon, Tuensang, Zunheboto, Wokha, Dimapur and Phek are placed under District Transport Officers.

Each of the Licensing office is supported by one or more technical officers in the rank of Senior Motor Vehicle Inspector/Motor Vehicle Inspector and non- technical officer in the rank of Senior Enforcement Inspector/Enforcement Inspector/ Assistant Enforcement Inspector and Motor Vehicle Checker.

FUNCTIONS AND DUTIES.

The Motor Vehicle Department is established in accordance with the provisions of section 213 (1) of Motor Vehicles Acts 1988 for the purpose of carrying into effect the provisions of the Act. It also discharges its functions as revenue department by way of collection of Road Tax and Passengers and goods tax. Road safety is an additional function of the department.

The Department also administers the Motor Accidents Claims Tribunal set up under Section 165 of M.V. Acts, 1988 for adjudicating upon claims for compensation in respect of accidents involving the death of, or bodily injury to persons arising out of the use of motor vehicles, or damages to any property of a third party so arising, or both.

The State Government has constituted Motor Accident Claims tribunals at Dimapur, Kohima, Mokokchung, Mon, Tuensang, Wokha, Phek, Zunheboto and has appointed the respective District & Session Judge/ Addl. District & Session Judge as its Member. Each is paid an honorarium of Rs.2000/-  per month for discharging duties as Member, MACT, in addition to their own assigned duties

Procedures followed in the decision making process, including channels of
supervision and accountability;

  1. Decision making process & channel of supervision and accountability for issue of driving   
    license- The decision for issue of learners license and driving license lies with the RTO/DTO subject
    to production of medical fitness certificate and conducting practical driving test by the MVI.
    Accountability equally lies with both the RTO/DTO and the MVI.
  2. Decision making process & channel of supervision and accountability for registration of Motor
    Vehicle– The decision for registration of any kinds of motor vehicles lies with the Registering
    authority on submission of physical vehicle inspection report by the M.V.I. The RTO/DTO when
    satisfied that the Motor Vehicle sale documents are genuine and the vehicle conforms with the road
    worthiness and pollution norms shall allow the registration. Accountability lies with both the
    R.T.O/D.T.O. and the M.V.I.
  3. Decision making process & channel of supervision and accountability for issue of permit by
    Regional Transport Authority- The Secretary Regional Transport Authority receives applications
    for issue of all kinds of road permit. The Board meeting is convened by the Chairman (Deputy
    Commissioner) where the Board decides the number of permits to be issued and selects the
    applicants.
  4. Decision making process & channel of supervision and accountability for issue of permit by the
    State Transport Authority- The Secretary State Transport Authority receives application for issue
    of permit for All India Tourist Permit and Inter Zonal operation of Public Service vehicles and
    National permit by the State Transport Authority. The Chairman STA (Secretary Transport)
    convenes Board meeting for consideration and disposal of the applications for public service permit.
    The applications for goods vehicle permit under “National Permit Schemes” are disposed off by the
    Secretary STA as there is no restriction for operation of goods vehicles.
  5. Decision making process & channel of supervision and accountability for revenue collection
    For assessment of tax to be paid on the basis of weight of the vehicles for non transport vehicles
    and the load capacity of the vehicles as prescribed by the manufacture are done by the MVI and the
    Head Assistant cum cashier and cross check by the RTO/DTO after which the correct tax to be paid
    is assessed. Accountability therefore lies with all the three level assessment.

 

  1. Decision making process & channel of supervision and accountability for financial sanction-
    Sanctions within the financial cognate power delegated to the Transport Commissioner is accorded
    by the Transport Commissioner subject to issue of drawl authority by the finance department.

Manual IV

Norms set by it for the discharge of its functions;

SARATHI: (for issue of Driving Learner’s/Permanent Licence)
The workflow in the process of issue of Learner’s License begins with the submission of prescribed application Form 1, 1A & 2 alongwith the mandatory documents to the authority for scrutiny. After due verification, fee is paid to the cashier. This is followed by capture of the biometrics of the applicant whose data is uploaded then. The data then is ready for the MVI to test and is passed to the Licencing Authority for approval. With the printing and signing by the Authority, the Learner’s licence issue cycle is completed.

Based on the Learner’s Licence within the period of its validity, an applicant submits duly filled Form 4 to the Licensing Authority where she/he is directed to deposit the driving test fee. The Motor Vehicles Inspector then conducts the practical driving proficiency test. The applicant is further directed to deposit the necessary fees. Details involved in the process are uploaded after which MVI verifies the particulars and is finally approved by the Licensing Authority. The processed detail is then pushed by the LO which then is printed and activated to finally complete the cycle of issue of PDL.

VAHAN: (for registration of Vehicles)
In the matter of registration of motor vehicles, the applicant first applies to the Registering authority in prescribed Forms alongwith the mandatory documents. The Motor Vehicle Inspector then inspects the vehicle for roadworthiness and cross checking the engine and chassis number as appended in the sale letter. The Motor Vehicle Inspector submits the mechanical inspection report with the confirmation of the load capacity (tonnage or seating capacity) of the vehicles if it is a transport the vehicle. With the completion of inspection and verification of documents, applicant deposits the required amount of fees and taxes after which the details of the vehicle and the owner are uploaded. It is then verified and approved by the Registering Authority and assigned the number. It is then pushed for print. The printed Smartcard is finally activated thus completing the cycle of registration of vehicles. It may be added that with a view to ensuring the fitment of the HSRP, data is uploaded only on production of the deposit receipt of the HSRP fee.

The State Transport Authority considers policy matter for issue of permit for operation of tourist vehicles and inter Regional operation of public service vehicles. Secretary State Transport Authority receives applications for issue of National Permit and All India Tourist permit as laid down under Section 88 (11) of CMV Rules 1989.

The letter NL is the State code allotted by the Central Govt. for registration of Motor Vehicles. The Registration code allotted to each Registering authority by the State Govt. are as follows.

The Motor Vehicles Department is not a developmental department but is a statutory authority with function of collection of Tax revenue. Therefore, there is no subsidy component scheme available in the Department.

The Department has posted a Citizens Charter in the State Government Website with explanatory note and has provided applications Forms prescribed under the Central Motor Vehicles Rules, 1989 that can be downloaded. The Citizens’ Charter also carries information on details of Compounding fee and various prescribed fees to be paid by the applicants for driving license, inspection fee and registration fees.
