Manual – I
Particulars of the Organisation, Functions and Duties under Section 4 (I) (b) (i) of Right to Information Act, 2005.
Prior to the attainment of the full fledged State of Nagaland, the Interim Body which functioned as de facto Legislative Assembly had existed from 18th February, 1961. The Interim Body was in a sense the predecessor of the present Legislative Assembly. On 21st August, 1962, a bill was introduced in Parliament and passed legalizing the formation of Nagaland as a full fledged State. The bill passed by the Parliament received President’s assent on the 4th September, 1962 and is known as the State of Nagaland Act, 1962. The Act provides for the formation of the State of Nagaland as the 16th State in the Indian union on 1st December, 1963.
The First Nagaland Legislative Assembly was constituted on 11th February, 1964. Since then the State had 12th General Elections and the present House, the 12th Assembly was constituted on 1st March, 2013.
The Nagaland Legislative Assembly is having 1 (one) House with 60 (sixty) elected Members.
The Nagaland Legislative Assembly Secretariat, besides providing secretarial assistance in legislative functioning of the Hon’ble Speaker, caters to the multifarious requirements of the Members of Legislative Assembly with a view to rendering them timely assistance in the discharge of their functions. The Legislative Secretariat also takes care of the welfare of the Members and Ex-Members.
The Business of the Nagaland Legislative Assembly is conducted according to the Rules of Procedure & Conduct of Business of the Nagaland Legislative Assembly and directions issued there under by the Speaker from time to time. The primary function of the Nagaland Legislative Assembly is to make laws for self – governing in a democratic manner by the people themselves. The service conditions of employees of Nagaland Legislative Assembly Secretariat are governed under the Nagaland Legislative Assembly Secretariat (Recruitment & conditions of Service 2nd Amendment) Rules, 2012

Decision Making Process:
The Procedure followed in decision making process including channels of supervision and accountability under Section 4(I) (b) (iii) of RTI Act, 2005. .
The duties and functions of the various Officers in the Secretariat are assigned by the Commissioner & Secretary keeping in view the expertise & knowledge of the Officers. The files are routed to the Commissioner & Secretary through the concerned Branch Officers for final decision. Financial matters, expenditure sanctions, decision-taking rest with the Commissioner & Secretary. All administrative & financial sanctions are issued in the name of the Speaker and all cases beyond the competence of the Commissioner & Secretary are endorsed to the Speaker for approval.

Norms for discharge of its functions:
The norms set for discharge of functions under Section 4(I) (b) (iv) of RTI Act, 2005. .
Administrative matters are dealt with as per provision of various Government Acts, Rules & Regulations adopted by this Secretariat from time-to-time. The Business of the State Legislative Assembly is conducted in accordance with the Rules of Procedure & Conduct of Business of Nagaland Legislative Assembly.

The rules, regulations, instructions, manuals and records held by it or under its control or used by its employees for discharging its functions under Section 4(I) (b) (v) of RTI Act, 2005.
The Service conditions of the employees are governed under *The Nagaland Legislative Assembly Secretariat (Recruitment & Conditions of Service) Rules, 1999(2nd Amendment Rules, 2012 Incorporated). Besides this; Salary, allowances & other facilities admissible to the Speaker/DeputySpeaker/Members of Nagaland Legislative Assembly & facilities to the Ex-Members of Nagaland Legislative Assembly are governed under separate Acts & Rules framed under the provisions of the constitution of India. The Business of the Legislative Assembly and its Committees are conducted according to the Rules of Procedure & Conduct of Business of Nagaland Legislative Assembly and directions issued by the Speaker there under from time to time.

(1). Assembly Committees
(a). Assembly Committees are the miniature House. They have been called the workshop of the House. Much of the work in every Legislature is done through the Committees.
(b). The Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly provide for the constitution of the following Committees.
(i). Committee on Public Accounts is constituted as per Rule 235 and Rule 236 of the Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly.
(ii). Committee on Estimate is constituted as per Rule 237, Rule238 and Rule 239 of the Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly.
(iii). Committee on Public Undertakings is constituted as per Rule 239A and Rule 239B of the Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly.
(iv). Business Advisory Committee is constituted as per Rule 222, Rule 223, Rule 224, Rule 225, Rule 226 and Rule 227 of the Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly.
(v). Committee on Petition is constituted as per Rule 233 and Rule 234 of the Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly.
(vi). Budget Committee is constituted as per Rule 236A of the Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly.
(vii). Committee on Priveleges is constituted as per Rule 240, Rule 241, Rule 242 and Rule 243 of the Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly.
(viii). Committee on Subordinate Legislation is constituted as per Rule 244, Rule 245, Rule 246, Rule 247, Rule 248 and Rule 249 of the Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly.
(ix). Committee on Papers laid on the table is constituted as per Rule 249A, Rule 249B and Rule 249C of the Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly.
(x). Committee on Government Assurances is constituted as per Rule 250 and Rule 251 of the Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly
(xi). Rules Committee is constituted as per Rule 252, Rule 253 and Rule 254 of the Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly.
(xii). House Committee is constituted as per Rule 255 and Rule 255A of the Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly.
(xiii). Library Committee is constituted as per Rule 256 and Rule 256A of the Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly.
(c). The first 3 (Three) Committees, namely Committee on Public Accounts, Committee on Estimates and Committee on Public Undertakings are known as Financial Committees of the House and the rest of the Committee are known as Non-Financial Committee of the House. The Financial Committees are elected by the House according to the principles of proportional representation by means of single transferable vote. The Non-financial Committees are
nominated by the Speaker. The life of all Committees is for one year.
(d). The House may also constitute ad hoc Committees like Select Committee on Bills for specific purpose. Such Committee became functus officio when they have reported on the matters referred to them by the House.
(e). The Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly provide for procedure to be followed by these Assembly Committees generally. The above rules also provide for the composition and function of each Committee.
(f). The Assembly Committees had framed its Internal Working Rules which were laid on the Table of the House on 29th March 1971. In the case of Select Committee on Bills, which are the ad hoc Committees, the Speaker had issued directions for regulating their detailed working.
(g). Meetings of the Assembly Committees are not open to public. As per Rules of Procedure and Conduct of Business in the Nagaland Legislative Assembly the sittings of a Committee shall be held in private.
(h). Minutes are not accessible to the public. As per Rules of Procedure and Conduct of Business in Nagaland Legislative Assembly no part of the evidence, oral or written report or proceedings of a Committee which has not been laid on the table shall be open to inspection by any one except under the authority of Speaker.

Since the Legislature Secretariat does not implement Schemes & has no direct contact with the public. Therefore, the work of Legislature Secretariat is completely different from that of other Government Department & Nagaland Government Secretariat. The Budget estimates as required to defray the charges of salary, allowances & other office expenses etc, during the financial year are allotted under “Head of Account” 2011-State Legislature 02-State Legislature 103-Legislature Sectt.

Manual XVII:
Such other information as may be prescribed and thereafter updated every year under Section 4 (I) (b) (xvii) of RTI Act, 2005.
- Nagaland Legislative Assembly Sessions: Normally 3 (Three) Sessions are held in a year. The Budget Session in the month of March, the Autumn Session in the month of August/September and Winter Session in the month of December.
1) Summoning of Assembly: Rule 3 of procedure and conduct of Business in Nagaland Legislative Assembly.
The Governor on the advice of the Chief Minister summons the Assembly and summoning letters to the members are issued by the Secretary, Nagaland Legisltive Assembly under the rules of procedure and Conduct of Business in Nagaland Legislative Assembly.
The Secretary shall issue a summon to each member specifying the date and place for a Session of the House:
Provided that when a Session is called at short notice or emergently, summons may not be issued to each member seperately but an announcement of the date and place of the Session shall be published in the Gazette and made in the press, and members may be inform by Telegram.
2) Governor Address: Rule 13 (1) of Procedure and Conduct of Business in Nagaland Legislative Assembly.
At the commencement of the first Session after each General Election to the Legislative Assembly and at the commencement of the first Session of each year, the Governor shall address the Assembly as required by Article 176 of the Constitution:
Provided that the making of the prescribed oath or affirmation by a member and in the case of a first Session held after each General Election to the Legislative Assembly, the Election of the Speaker shall precede the Governor’s address.
3) Adjournment of the House: Rule 12 of procedure and Conduct of Business in Nagaland Legislative Assembly. The Speaker shall determine the time when a sitting of the House shall be adjourned sine die or to a particular day, or to an hour or part of the same day: Provided that the Speaker may, if he thinks fit, call a sitting of the House before the date or time to which it has been adjourned or at any time after the House has been adjourned sine die.
4) Prorogation of Assembly: After every Session the Governor Prorogues the House as per provision of Article 174 (2) (a) of the Constitution of India.
5) Budget: Presentation of budget- Rule 145 of procedure and Conduct of Business in Nagaland Legislative Assembly. The annual financial statement or the statement of the estimated receipts and expenditure of the State in respect of every financial year (hereinafter referred to as “The Budget” (Shall be presented to the Assembly on such day in the preceding financial year as the Governor may appoint.
6) Demands for Grants: Rule 147 of procedure and Conduct of Business in Nagaland Legislative Assembly. A separate demand shall ordinarily be made in respect of the grant proposed for each Department of the Government, provided that the Minister-in-charge of the Finance Department may, in his discretion, include in one demand grants proposed for two or more Departments or make the demand in respect of expenditure, which cannot readily be classified under particular Departments.
(7) Cut Motion: Rule 151 of procedure and Conduct of Business in Nagaland Legislative Assembly.
A motion may be moved to reduce the amount of a demand in any of the following ways:
a) Policy Cut : representing disapproval of the policy underline the demand.
b) Economy Cut : the amount of the demand be reduce by a specified amount representing the economy that can be effected.
c) Token Cut : to ventilate a specific grievance which is within the sphere of the responsibility of the Government of the State.
