Particulars of organization, functions and duties under section 4(1)(b)(i) of Right to Information Act, 2005 Introduction

Introduction

  • In order to promote transparency and accountability in the working of every public authority and to empower the citizens to secure access to information under the control of each public authority, the Government of India have enacted “The Right to Information Act, 2005”, (RTI Act) which came into force on 15.06.2005. In accordance with the provisions of section 4(1) (b) of this Act, the Department of Information Technology and Communication, Government of Nagaland has brought out this manual for information and guidance of the stakeholders and the general public.

 

  • The purpose of this manual is to inform the general public about this Department’s organizational set-up, functions and duties of its officers and employees, records and documents available with the Department.
  • This manual is aimed at the public in general and users of the services, and provides information about the schemes, projects and programmes being implemented by the Department of Information Technology and communication and the organizations under its administrative control.

  • The procedure and fee structure for getting information, Provisions as per Government notificationvide AR-3/Gen-147/2005 (A) Dated Kohima  the 30th November, 2005:-

 

  • A request for obtaining information under sub-section (1) of section 6 shall be accompanied by an application fee of rupees ten by way of cash against proper receipt or by demand draft or bankers cheque payable to the Accounts Officer/Head of Department/Head of Office of the public authority or the Government Department/Office.
  • For providing the information under sub-section (1) of  section 7, the fee shall be charged by way of cash against proper receipt or by demand draft of bankers cheque payable to the Accounts Officer/ Head of Department/Head of Office of the public authority or Government Department/ Office at the following rates:-
  • Rupees two for each page (in A-4 or A-3 size paper) created or copied;
  • Actual charge or cost price of a copy is given in larger size paper;
  • Actual cost or price for samples or models; and
  • For inspection of records, no fee for the first hour; and a fee of rupees five for each subsequent hour (or fraction thereof).
  • For providing the information under sub-section (5) of section 7 the fee shall be charged of cash by way of cash against proper receipt or by demand draft or bankers cheque payable to the Accounts Officer/  Head of Department/Head of Office of the public authority or Government Department/ Office at the following rates:-
  • For information provided in diskette of floppy rupees fifty per diskette or floppy; and
  • For information provided in printed form at the price fixed for such publication or rupees two per page of photocopy for extracts from the publication.
  • The fees collected under these rules shall be deposited at the end of every month, in the Government Treasury through a Treasury Challan and credited to the Head of Accounts “ 0070- Other Administrative Services”.

  •    Background

The Department and Directorate of Information Technology was created vide notification No. AR-3/GEN-111/2003 dated 3rd November 2003. The World Bank Assisted Project of the State Level Project Implementation Unit (SPIU) was transferred from the Directorate of Higher & Technical Education along with manpower and assets.
The subject matter of Technical Education from the Department of Higher & Technical Education was transferred to the Department of Information Technology vide notification no. AR-15/1/85 dated 19th August 2004.
The Departments of Information Technology, Communication, Technical Education and Science & Technology was further re-structured vide OM no. AR-15/1/85(Pt) Dated 23rd July 2009 and the subject matter of Communication under Transport Department merged with the Department of Information Technology and named as Department of Information Technology & Communication (IT&C).
The Department of Information Technology & Communication (IT&C) is now playing a key role to transform the State of Nagaland into a modern State by way of improving transparency, efficiency and   ensuring cost effective public service delivery to  the  citizens. The State is witnessing a paradigm shift in Governance and all other spheres of life and Information Technology and electronic media is enabling a knowledge–led economy. The world is now looking up to India to drive the global economic growth and India is looking towards east to open eastern corridors towards South East Asia to promote economic growth. The Department of IT&C is fully aware that it is the right time to take the State of Nagaland to the next higher level through e-Governance and ICT based technologies.

The Department performs the function of   the Secretariat for the IT Council and the State Level Coordination Committee for IT applications and the following are the executive business and duties:

  • Formulating State IT Policy.
  • Planning & Coordination of IT related programme and projects.
  • Technical support to Government Departments for IT enabled services.
  • Research & Development of new technologies and prescribe uniform standards.
  • Pro-active promotion of Citizen Centric services
  • Capacity Building and organizing of IT events.
  • Planning, providing Internet access, Network security, Bandwidth management etc.
  • Implementation of core infrastructure projects under the National  e-Governance Plan (NeGP)
  • E-governance initiatives.
  • Co-ordinating  e-Procurement and Tendering activities.

 

The core infrastructure projects under the National e-Governance Plan (NeGP) which the Department of IT&C is implementing consists of the State Data Centre, State Wide Area Network, State Portal & State Services Delivery Gateway, Capacity Building and Common Service Centre. The projects under the NeGP are executed by the Nagaland State                   e-Governance Society (NSeGS) which is the designated nodal and implementing agency. The Department is also facilitating various co-stake holder Departments to initiate implementation of respective Mission Mode Projects and applications for delivery of electronics services.

The Department has also initiated and implemented various core IT infrastructural projects and applications to facilitate the delivery of electronics services provided by various departments.

  • Vision

The vision of the Department is to make the State a destination for investors           both within and outside the country and to initiate the people of the State to         take advantage of this technology through e-Governance and providing IT- enabled services to the State, which shall aim at facilitating in providing a SMART (Simple, Manageable, Approachable, Responsive and Transparent)  Government to the people, and also to inculcate quality Technical Education that caters to the demand of industry and the people.

  • To play the role of a facilitator; defining standards; providing infrastructure support; interfacing with related institutions within the country and outside and build regulatory mechanisms.
  • Creation and systematic enhancement of IT infrastructure in the State through Public Private Partnerships.
  • Development of human resource by widening the reach of IT education in terms of quality and spatial coverage with a view to improving  the employability of youth.
  • Encourage e-Commerce to overcome the handicap of remoteness.

    • Bringing transparency in Government operations through Government-citizen interface.(G2C)
    • Improving the efficiency and effectiveness of Government’s service delivery systems.

Addl. Director & Head of the Department

The Director is the head of office. He is responsible for the careful observance of the Business Rules and Secretariat Instructions in the transaction of the business in the department. He exercises general supervision and control over the staff under him and is responsible for seeing that the members of the staff do the work allotted to them efficiently and expeditiously. Policy matters and all important matter should be dealt with in consultation with the Commissioner & Secretary who will be in over all charge of the Department.

Joint Director

He is also the drawing and disbursing officer (DDO) and looks after all establishment matters of the Directorate, Administration of all technical matters and overseeing the implementation of all IT activities and projects.

Senior Program Officer/Deputy Director

There are three (3) Senior Program Officer and one Deputy Director under the Directorate of Information Technology & Communication and the Officer is assigned with the following activities:-

  • Research and Development
  • Training and Skill Development
  • Technical matters relating to SP&SSDG, MMPs, ITeS, ESDM, mGovernance, FTS, eProcurement and Tendering.
  • Technical matters relating to STPI, CSC, e-Mass Literacy, IPV6, OFC/Wireless Network
  • IT Policy/ projects and Technical opinions being sought by user Departments.

Program Officer

There is one (1) Program Officer in the Directorate who are assigned with the implementation of following activities:-

The powers and duties of the officers in the Secretariat are indicated below:

Secretariat
The Department at Secretariat is confined to general direction, legislation, Assembly business, inter-departmental matters, formulation of the policy of the Government within its sphere of responsibility and review/assessment of execution of policy/ programmes. Its functioning is

governed by established rules and procedures as enumerated in the Nagaland State Secretariat Manual of Office Procedure, Rules of Executive Business and other relevant rules such as the General Financial Rules/Delegation of Financial & Cognate Power Rules, Fundamental Rules and Subsidiary Rules, Leave and Pension Rules, government Servant Discipline & Appeal Rules/ Conduct Rules, General Notifications, Orders, Circulars and other instructions issued by Government from time to time.

Commissioner & Secretary

The Commissioner & Secretary is the Administrative Head of the department. He is the Principal Adviser of the Minister in-charge of the Department on all matters of policy and administration within the Department; he exercises complete and undivided control in supervision in the works of the department including liaison and references with the Central Ministries and other State Government Departments. Policy matters are put up to the Advisor to Chief Minister/Chief Minister (Minister in charge of the Department) through the Chief Secretary, who is the Principal Officer of the Government responsible for overall control and administration of the state Government.

Addl.Secretary/Joint Secretary/Deputy Secretary/Under Secretary

The Addl.Secretary/Joint Secretary/Deputy Secretary/Under Secretary exercise administrative control of supervising the activities of the staff. He is delegated by authority for disposal of routine matters at his level. He examines papers/cases before submitting to the Additional Secretary and Commissioner & Secretary. He is also authorized to make departmental references and performs such other duties and functions as are assigned and delegated to him by higher authority. The officer is entitled to stenographic assistance.

Section Officer

The Section Officer is the officer in charge for day to day work in the branch. The general duties include supervision and evenly distribution of works among the assistants, training, assisting and advising the staff in maintenance of office decorum and conduct of official business. He is also responsible for making corrections in the draft and corrected letters are complete with the necessary enclosures and attachments before issue. He is also responsible for efficient and expeditious disposal of work and checks on delays to ensure that no paper or file is overlooked. He supervises proper maintenance of records and indexing of files. Important and complicated cases are dealt by the Section Officer besides any other delegated assignments that are authorized to be taken independently.

Junior Section Officer/Secretariat Assistants

The Junior Section Officer and Secretariat Assistants work under the supervision of the Section Officer and are responsible for the work/subject matters assigned to them. In putting up cases in file, it is ensured that facts and figures are pointed out correctly and attention of the higher authorities are drawn to any precedents, orders, rules and regulations on the subject. Where the line of action is clear or clear instructions are given by the Branch Officer or higher officers, a draft with less noting is put up for approval of authority. The Assistants are also responsible for registration of Dak / letters, maintenance of Branch Receipt Diary, File Register, File Movement Register, Indexing and Recording, Guard File, Typing, comparing, Dispatch, preparation of statements, submission of routine and simple drafts etc.

Typists

They are responsible for tying out the approved draft letters/documents and also help in data entry and maintenance of record in computerized form and other works assigned from time to time.

Peons

They perform tasks such as distribution of Dak to the concerned dealing Assistants, carrying files to the various level of officials/ offices within and outside the Department, handing over letters to Departments and branches in the Secretariat, Dak duty for Ordinary and Registered letters at Post Office and such other duties assigned by officers and staff of the Department.

The powers and duties of the officers in the Nagaland State eGovernance Society (NSeGS) are indicated below:

The Department is implementing core infrastructure projects under the National e-Governance Plan (NeGP) which consists of the State Data Centre, State Wide Area Network, State Portal & State Services Delivery Gateway, Capacity Building and Common Service Centre. Chief Executive Officer (CEO)

The Executive Committee of the Nagaland State eGovernance Society (NSeGS) is headed by Commissioner & Secretary, IT&C as the Chief Executive Officer. He exercises general supervision and take all administrative decisions of the society.

Member Secretary

He is empowered to take all day to day administrative decisions where no policy is involved and looks after all establishment matters of the NSeGS and overseeing the implementation of IT activities and projects.

Administrative Officer

He is empowered to manage and look after all establishment matters of the NSeGS and overseeing the implementation of IT activities and projects.

Seniors Project Engineer

There are 3 (three) Seniors Project Engineers in the Society who are assigned with the implementation of following activities:

  • Internet and Website Security Policies
  • Research and Development
  • Implementation of various core National eGovernance Plan Project (NeGP) including

He is responsible for maintaining all NSeGS Account Matters and preparation & maintenance of Bills and Vouchers, Budgeting and Utilization Certificates of funds.

In order to promote computerization and e-Governance in the State, various committees are

Procedure for file routing:

  • All matters pertaining to Accounts shall be routed from concerned dealing Assistant to Assistant Supdt./Superintendent/Accounts Officer to DDO and the same shall be routed to HoD
  • All matters relating to establishment shall be routed from Dealing Assistant to Superintendent to Joint Director and the same shall be routed to HOD.
  • Establishment Matters relating to GPF, HRA, TA/DA, medical re-imbursement, services loan and pension matters shall be routed from Dealing Assistant to concerned Officer in-charge  to Joint Director and the same shall be routed to HOD.
  • All matters relating to Transport and Vehicles shall be routed from Dealing Assistant to concerned Officer in-charge to Joint Director and the same shall be routed to HOD.
  • All proposals shall be initiated from  the respective section and routed to DDO and the same shall be routed to HOD
  • Matters relating to project shall be routed from concerned Officer in-charge to Joint Director and the same shall be routed to HOD

File/ Dak movement shall be logged in the Receipt /Dispatch section.

Secretariat:

The Secretariat follows the Manual of Office Procedure for Nagaland Civil Secretariat, 1969 amended from time to time and the Rules of Executive Business for Government of Nagaland, and other rules / regulations etc in the process of decision making and transaction of official business which go through various levels.

The receipts are firstly diarized and handed over to the dealing assistant who dockets the receipt, process in the file and put up to the Section Officer  who puts up to the Under Secretary for disposal of the cases of routine matters. In case of important matters, the file is put up to the Additional Secretary and to the Commissioner & Secretary for final approval. In respect of policy matters the approval of Chief Secretary and the Minister in charge and is obtained.

Similarly inter departmental references and consultations required for cases are made / taken and submitted to the Chief Secretary and Minister in charge for final approval.

Norms set by it for the discharge of its functions

The Department of IT&C is functioning by three categories; Directorate functions under the control of Addl. Director as HoD. He is responsible for the careful observance of the Business Rules and Secretariat Instructions in the transaction of the business in the department. Administrative and Nagaland State eGovernance Society functions under the control of Commissioner & Secretary. He is the Principal Adviser of the Minister in-charge of the Department on all matters of policy and administration within the Department.  He is also the Chief Executive Officer and exercises general supervision and takes all administrative decisions of the society in implementation of National eGovernance Plan.

Purpose:
The main objective of IT council is to formulate policy guidance for IT development in the State.

Functions:
The Committee will set priority amongst projects, allocate required resources and resolve inter-departmental issues in the implementation of Digital India Program.

Nagaland State eGovernance Society (NSeGS)

The Nagaland State eGovernance Society (NSeGS), a registered society vide no RS/HOME/5570/2008. Dated 23rd October 2008 is the designated nodal and implementing agency of core projects under the National egovernance Plan (NeGP)

Technical Support to other Government Department

The Department of Information Technology& Communication through the State e-Mission Team (SeMT) is actively pursuing development of Mobile Applications for various Government Departments and Agencies. Presently, a total of 5 (five) mobile apps for the android platform is being developed for the Department of Agriculture as part of the MoU executed between the Departments in May 2017 which includes development and support for the mobile apps for a period of 3 (three) years. Presently, 2 (two) apps have been developed and available in the Google Play Store for free download by the end user.
