It is a statutory body duly constituted through an Act of Parliament (Central Act No.22 of 2005).\u00a0 It comes under the administrative umbrella of the Personnel &amp; Administrative Reforms Department under the Nagaland State Government.<\/p>\n<p>&nbsp;<\/p>\n<p>On the recommendation of the Appointment Committee constituted in terms of Section 15(3) of the Right to Information Act, 2005 and under the provision of Section\u00a0 15(1) &amp; (2) of the said Act, His Excellency, the then Governor\u00a0 of Nagaland, Shri. Kekongchinm Yimkhiung<\/td>\n<td width=\"111\">State Information Commissioner<\/td>\n<td width=\"94\">29\/11\/2022<\/td>\n<td width=\"104\">28\/11\/2025<\/td>\n<td width=\"116\">NGO<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>&nbsp;<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Objective <\/strong>\u2013 To fulfil the mandate assigned in the RTI Act, 2005 by exercising the powers conferred on, and to perform the functions assigned to it under the Act.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Mission <\/strong>\u2013 Ensure the citizens their Right to Information from public authorities in accordance with provisions of the Right to Information Act, 2005.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Vision <\/strong>\u2013 Transparent functioning of public authorities to enable in achieving the goals envisaged in the Constitution of India for every Indian citizen.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Parent Government Department \u2013 <\/strong>Department of Personnel and Administrative Reforms, Government of Nagaland.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Reporting to which authority <\/strong>\u2013 Though the Commission is under the Department of Personnel and Administrative Reforms, Government of Nagaland, the Commission enjoys complete autonomy and submits its annual report as envisaged in the Right to Information Act 2005 to the Nagaland Legislative Assembly through the Department of Personnel and Administrative Reforms, Government of Nagaland.<\/p>\n<p><strong>Jurisdiction <\/strong>\u2013: All public authorities under the Nagaland State Government or established by an Act of the State Government or substantially funded by the Nagaland State Government. It does not cover those Central public authorities located within the State.<\/p>\n<p><strong><u>Functions and Powers of the Commission:<\/u><\/strong><\/p>\n<p>As\u00a0 per\u00a0 the\u00a0 RTI\u00a0 Act,\u00a0 2005\u00a0 the\u00a0 Nagaland Information\u00a0 Commission\u00a0 is\u00a0 assigned\u00a0 with\u00a0 the\u00a0 task\u00a0 of\u00a0 receiving\u00a0 complaints\u00a0 and\u00a0 appeals, for\u00a0 providing\u00a0 suitable\u00a0 relief\u00a0 to\u00a0 the\u00a0 complainants or appellants\u00a0 as\u00a0 per\u00a0 the\u00a0 provision\u00a0 of\u00a0 the\u00a0 RTI\u00a0 Act,\u00a0 2005. The Act gives the Information Commission very broad ranging decision making powers. The Commission\u00a0 shall\u00a0 perform\u00a0 all\u00a0 other\u00a0 responsibilities\u00a0 as\u00a0 assigned\u00a0 to\u00a0 it, autonomously\u00a0 without\u00a0 being\u00a0 subjected\u00a0 to\u00a0 direction\u00a0 given\u00a0 by\u00a0 any\u00a0 other\u00a0 authority\u00a0 under this Act.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><strong>a)<\/strong> <strong>Receives and inquires into complaints<\/strong><\/li>\n<\/ol>\n<p>Under Section 18 of the RTI Act, 2005, the Commission has the power to receive and inquire into a complaint from\u00a0 any person, who is unable\u00a0 to\u00a0 submit\u00a0 a\u00a0 request\u00a0 to\u00a0 Public\u00a0 Information\u00a0 Officer\u00a0 either\u00a0 by\u00a0 reason\u00a0 that\u00a0 no such officer has\u00a0 been appointed under\u00a0 this Act, or because the Public Information Officer has\u00a0 refused\u00a0 to\u00a0 accept\u00a0 his or\u00a0 her\u00a0 application\u00a0 or\u00a0 appeal\u00a0 under\u00a0 this\u00a0 Act or the applicant has not received any response from PIO. If\u00a0 the Commission is\u00a0 satisfied that\u00a0 there\u00a0 are\u00a0 reasonable\u00a0 grounds\u00a0 to inquire\u00a0 into the\u00a0 matter,\u00a0 it may\u00a0 initiate\u00a0 an inquiry\u00a0 in\u00a0 respect\u00a0 thereof.\u00a0 During\u00a0 the\u00a0 inquiry\u00a0 of\u00a0 any\u00a0 complaint\u00a0 under\u00a0\u00a0 this\u00a0 Act,\u00a0 the Commission\u00a0 has\u00a0 the\u00a0 power\u00a0 to\u00a0 examine\u00a0 any\u00a0 record\u00a0 to\u00a0 which\u00a0 this\u00a0 Act\u00a0 applies\u00a0 which\u00a0 is under\u00a0 the\u00a0 control\u00a0 of the public\u00a0 authority,\u00a0 and\u00a0 no such\u00a0 record\u00a0 may be withheld\u00a0 from\u00a0 it\u00a0 on any\u00a0 grounds.\u00a0 While\u00a0 making\u00a0 an\u00a0 inquiry\u00a0 the\u00a0 Commission\u00a0 shall\u00a0 have\u00a0 all\u00a0 powers,\u00a0 as\u00a0 are vested in\u00a0 a\u00a0 civil\u00a0 court while\u00a0 trying\u00a0 a suit\u00a0 under\u00a0 the\u00a0 Code\u00a0 of Civil\u00a0 Procedure, 1908 in respect of the following matters, namely:\u2014<\/p>\n<p>&nbsp;<\/p>\n<p>(a)\u00a0 summoning and enforcing the attendance of persons and compel them to give oral or written evidence on oath and to produce the documents or things;<\/p>\n<p>(b)\u00a0\u00a0 requiring the discovery and inspection of documents;<\/p>\n<p>(c)\u00a0 receiving evidence on affidavit;<\/p>\n<p>(d)\u00a0 requisitioning any public record or copies thereof from any court or office;<\/p>\n<p>(e)\u00a0\u00a0 issuing summons for examination of witnesses or documents; and<\/p>\n<p>(f)\u00a0 any other matter which may be prescribed.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><strong>b) <\/strong><strong>Deciding Appeals<\/strong><\/li>\n<\/ol>\n<p>Under Section 19(3) of the RTI Act, 2005, the Commission can receive second appeal within ninety days from the date on which the decision should have been made or was actually received. However, the State Information Commission may admit the appeal after the expiry of the period of ninety days if it is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time.<\/p>\n<p>&nbsp;<\/p>\n<p>An appeal submitted against the decision of the Public Information Officer relating to information of a third party, the State Information Commission, shall give a reasonable opportunity of being heard to that third party.<\/p>\n<p>&nbsp;<\/p>\n<p>In any appeal proceedings, the onus to prove that a denial of a request was justified shall be on the State Public Information Officer, who denied the request.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<ol>\n<li><strong>c) Imposing Penalties<\/strong><\/li>\n<\/ol>\n<p>Under Section 20 of the RTI Act, 2005, at the time of deciding any complaint or appeal, the Commission is of the opinion that the PIO has, without any reasonable cause, refused to receive an application for information or has not furnished information within the stipulated time frames or malafidely denied the request for information or knowingly given incorrect, incomplete or misleading information or destroyed information which was the subject of the request or obstructed in any manner in furnishing the information, it shall impose a penalty of Rs. 250.00 (Rupees two hundred and fifty only) each day of delay till application is received or information is furnished, subjected to a maximum amount of Rs. 25,000.00 (Rupees twenty-five thousand only).<\/p>\n<p>&nbsp;<\/p>\n<p>However, before imposing any penalty on the PIO, the Commission shall give reasonable opportunity of being heard and the burden of proving that he acted reasonably and diligently and that the denial of a request was justified shall be on the PIO, who denied the request.<\/p>\n<p>&nbsp;<\/p>\n<p>The decision of the Commission shall be binding.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><strong>d) Disciplinary Action<\/strong>:<\/li>\n<\/ol>\n<p>At the time of deciding any complaint or appeal, if the Commission is of the opinion that the Public Information Officer has without any reasonable cause and persistently, failed to receive an application for information or has not furnished information within the time specified under sub-section (1) of section 7 or malafidely denied the request for information or knowingly given incorrect, incomplete or misleading information or destroyed information which was the subject of the request or obstructed in any manner in furnishing the information, it shall recommend for disciplinary action against the Public Information Officer, under the service rules applicable to him.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><strong>e) Compensation:<\/strong><\/li>\n<\/ol>\n<p>The Commission may also require the public authority to compensate the complainant for any loss or other detriment suffered;<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<ol>\n<li><strong>f) <\/strong><strong>Compliance with the Act:<\/strong><\/li>\n<\/ol>\n<p>The Commission may also require a public authority to take necessary steps to secure compliance with the provisions of the Act:<\/p>\n<p>(i)\u00a0 by providing access to information, if so requested, in a particular form;<\/p>\n<p>(ii)\u00a0 by appointing a Public Information Officer<\/p>\n<p>(iii) by publishing certain information or categories of information;<\/p>\n<p>(iv)\u00a0 by making necessary changes to its practices in relation to the maintenance, management and destruction of records;<\/p>\n<p>(v)\u00a0 by enhancing the provision of training on the right to information for its officials;<\/p>\n<p>(vi)\u00a0 by providing it with an annual report in compliance with clause (b) of sub-section (1) of section 4;<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<ol>\n<li><strong>g) Recommend steps<\/strong><strong> for conformity<\/strong><\/li>\n<\/ol>\n<p>If it appears to the Commission that the practice of a public authority in relation to the exercise of its functions under the RTI Act, 2005 does not conform with the provisions or spirit of RTI Act, 2005 it may recommend to the authority, such steps and changes to the functions and practices of public authority so as to promote and conform with the provisions or spirit of the Act.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><strong>h) Information relating to allegations of Human Rights violation:<\/strong><\/li>\n<\/ol>\n<p>If the information sought for is in respect of allegations of violation of human rights, the information shall only be provided after the approval of the Commission, and such information shall be provided within forty-five days from the date of the receipt of request.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><strong>i) Monitoring and Reporting<\/strong><\/li>\n<\/ol>\n<p>The Commission shall, as soon as practicable after the end of each year, prepare a report on the implementation of the provisions of RTI Act, 2005 during that year and forward a copy thereof to the appropriate Government\u00a0 to be laid before the State Legislature.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>General management:<\/strong><\/p>\n<p>The general superintendence, direction and management of the affairs of the Nagaland\u00a0 Information\u00a0 Commission vests\u00a0 in\u00a0 the Chief\u00a0 Information\u00a0 Commissioner\u00a0 who\u00a0 is assisted\u00a0 by\u00a0 the\u00a0 State\u00a0 Information\u00a0 Commissioners\u00a0 and\u00a0 exercises\u00a0 all\u00a0 such\u00a0 powers\u00a0 and\u00a0 functions autonomously\u00a0 without\u00a0 being\u00a0 subjected\u00a0 to\u00a0 directions\u00a0 by\u00a0 any\u00a0 other\u00a0 authority under the RTI Act.<\/p>\n<p>&nbsp;<\/p>\n<p>The\u00a0 Act\u00a0 enjoins\u00a0 upon\u00a0 the\u00a0 State\u00a0 government\u00a0 to\u00a0 provide\u00a0 the\u00a0 Chief\u00a0 Information Commissioner\u00a0 and\u00a0 the\u00a0 State\u00a0 Information\u00a0 Commissioners\u00a0 with\u00a0 such\u00a0 officers\u00a0 and employees as\u00a0 may be necessary for the efficient performance of their functions under this Act, and the\u00a0 salaries\u00a0 and allowances payable to and the\u00a0 terms and conditions of service of the\u00a0 officers\u00a0 and\u00a0 other\u00a0 employees\u00a0 appointed\u00a0 for\u00a0 the\u00a0 purpose\u00a0 of\u00a0 RTI Act, 2005 shall\u00a0 be\u00a0 such\u00a0 as may\u00a0 be\u00a0 prescribed.<\/p>\n<p>&nbsp;<\/p>\n<p>Besides the Information Commissioners, there are <strong><u>23 employees<\/u><\/strong>, headed by the Secretary for the routine office management of functions. When the Commission admits appeals or complaints, and hearing is scheduled, the parties (appellant\/complainant and PIO) are summoned for hearing, giving opportunity of being heard. Cases are usually heard in full bench of the Commission. The Commission may also hear more than one case (appeals or complaints) on a single day. Usually cases are closed in a single hearing, but in some cases the Commission may hear several hearings on a single case till it is satisfied for closure.<\/p>\n<p><strong>RTI Implementation: <\/strong><\/p>\n<p>The Commission had prescribed a format for the submission of the RTI implementation by the public authorities in the State at the end of every year. The period followed by the Commission for the RTI implementation is from April to March. The RTI implementation submitted by the public authorities are analysed and Annual Report is prepared basing on the analysis.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>RTI Annual Report.<\/strong><\/p>\n<p>The Commission prepares an annual report on the implementation of the provisions of the RTI Act, as soon as practicable after the end of each year. Cases are usually heard by the full bench of the Commission, except when the CIC or any of the SICs are on tour or on leave. Cases are also heard as per the convenience of the public authorities. Hearings are usually held, in the personal presence of both the parties. If the appellant cannot attend, still hearings are held.
